5th Circuit Court of Appeals Ruling on the Angola Three Case"On May 13th, the U.S. Court of Appeals for the Fifth Circuit, in the case of Robert King Wilkerson: Albert Woodfox: Herman Wallace (Plaintiffs) vs. Richard L. Stalder; Burl Cain, Tom Norris; Richard Peabody; R. Rachal; Sam Smith and Paul J. Myers (Defendants) - ruled to affirm the district court's denial of the prison officials Motion to Dismiss. This ruling allows the ACLU and the defendants to proceed with their case against Louisiana State Prison officials charging them with constitutional violations, particularly Eight Amendment (cruel and unusual punishment) and 14th Amendment (right to due process) violations. These charges stem from the illegal and unethical detention of the defendants in solitary confinement for over 30 years. Successful litigation of these charges could set legal precedent for the more humane review of the escalating incidences of inmates being left in solitary for indeterminate amounts of time at the whim of prison officials." ---------------------
